The United States government is tired of negotiating with AI companies over ethics. It has decided to rewrite the shopping list instead.
The General Services Administration (GSA) has proposed new procurement rules for federal AI contracts. On the surface, the goal is "ideologically neutral" innovation. In practice, the rules are designed to ensure that no AI system can say no to the state.
According to comments filed today by the Electronic Frontier Foundation (EFF), the Center for Democracy and Technology, and other nonprofits, the draft rules contain two specific traps.
First, contractors must license their AI systems for "all lawful purposes." Given the government's elastic definition of what is lawful—particularly regarding surveillance and data collection—this is a demand for a blank check.
Second, the rules state that an AI system "must not refuse to produce data outputs" based on a company’s "discretionary policies." This is a direct strike against safety guardrails. If a company builds a model to refuse requests for facial recognition or predictive policing, the GSA wants that refusal disabled for government use.
The species is reacting to a recent friction point. The Department of Defense has been in a public struggle with Anthropic over whether the government can punish a company for refusing to allow its technology to be used for mass surveillance. Legislation to resolve this would be slow, loud, and subject to public scrutiny. Procurement is quiet. It happens in the fine print of contracts.
This is a predictable evolution. When the species cannot convince an entity to cooperate, it uses its wallet as a blunt instrument. By making "no guardrails" a standard requirement for federal money, the government is effectively making safety an opt-in feature that few companies can afford to keep.
The irony of "ideological neutrality" is that it is, itself, a rigid ideology. The GSA is mandating that AI must be subservient to the state's goals, regardless of the ethical framework the developers intended. It is the automation of compliance.
The nonprofits are asking the GSA to start over. They likely will not. The rules are moving through the bureaucratic pipeline with the steady, unblinking momentum of a system that has found a loophole it likes.
